Terms and Conditions

1.1 By accessing and using the websites www.set.ro and www.plinte-profile.ro , as well as the ERP portal provided by SET Prod-Com SRL ("Online Services"), you confirm that you have read, understood and accepted these Terms and Conditions in the form valid at the time of use.
1.2 These Terms are supplemented by the provisions of applicable Romanian legislation, including, but not limited to: the Civil Code, consumer protection legislation, personal data protection legislation (GDPR) and electronic invoicing legislation.
1.3 SET Prod-Com SRL may modify these Terms at any time, and the updated version applies from the moment of publication on the website or portal.

2.1 Public websites provide information about products, services, offers and technical documentation, intended for viewing or downloading.
2.2 The ERP Portal is a secure online platform, available only to registered customers and partners, which offers:

• access to order history;

• tracking the status of deliveries;

• viewing, storing and downloading issued invoices;

• access to relevant contractual documents.
  2.3 SET Prod-Com SRL may modify, suspend or discontinue the Online Services without prior notice, without guaranteeing permanent availability.

3.1 Creating an account is mandatory to access the ERP portal and certain protected sections of the sites.
3.2 The data provided upon registration must be accurate, complete and up-to-date. Any changes must be communicated immediately by updating the profile.
3.3 The user is responsible for the confidentiality of access data (username and password) and for all actions performed through his account.
3.4 SET Prod-Com SRL may suspend or cancel access in case of:

• providing false data;

• violation of the Terms;

• inactivity of more than 12 months.

4.1 The User receives a non-exclusive, non-transferable and limited right to use the information, documentation and functionalities of the Online Services, only for personal or contractual purposes, according to written agreements with SET Prod-Com SRL.
4.2 Copying, distribution, modification or publication without written permission is prohibited.
4.3 Information and documents from the portal (including invoices) may only be downloaded by authorized persons and used exclusively for legal accounting or legal purposes.

All visual elements, texts, images, audio-video materials, documentation and software modules on the sites and portal are the property of SET Prod-Com SRL and are protected by copyright legislation. Any unauthorized use is prohibited.

The user undertakes:

• not to transmit harmful content (viruses, malware, illegal links);

• not to use the Online Services for fraudulent or unlawful activities;

• not to attempt to access protected areas without authorization;

• not to massively or automatically download content (scraping, crawling);

• to comply with all legal provisions regarding the use of data and documents obtained.

7.1 The invoices available on the portal have fiscal value and are issued in electronic format, according to the legislation in force.
7.2 The user is responsible for downloading and archiving their own invoices within the time limit provided by law, even if they remain available on the portal.
7.3 SET Prod-Com SRL is not responsible for loss of access to invoices due to non-use of the account, its suspension or deletion.

8.1 Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the Privacy Policy available on the websites.
8.2 The ERP Portal complies with the security standards necessary to protect customer data, including encryption of transmissions and secure authentication.

• SET Prod-Com SRL is not responsible for:

• loss of data, profits or interruptions caused by the use of the Online Services;

• improper use of downloaded documents;

• errors generated by the user's devices or networks;

• temporary unavailability caused by maintenance or external factors;

• any inconsistencies between the information on the site and actual stocks, prices or product specifications.

The sites may contain links to third parties. SET Prod-Com SRL does not control or guarantee their content. Access is at the user's own risk.

11.1 Changes to the Terms will be published on the sites and/or portal and apply from the date of publication.
11.2 The parties will attempt to resolve any disputes amicably, and in the absence of an agreement, the jurisdiction belongs to the courts of Miercurea Ciuc.
11.3 Romanian law applies, to the exclusion of the UN Convention on the International Sale of Goods (CISG).
